The terms governing your use of the PIN platform and services
These Terms of Service ("Terms") govern your access to and use of the PIN · OS platform, website, and related services ("Services") provided by Pain Innovation Network ("PIN", "we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms.
By creating an account or using our Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use our Services.
You must be at least 18 years of age and a licensed healthcare professional, researcher, or authorized organizational representative to use our platform. By using our Services, you represent that you meet these requirements.
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
When you use our Services to process Protected Health Information (PHI), you represent that you are a Covered Entity or Business Associate under HIPAA with appropriate authorization to handle such data. PIN operates as a Business Associate and will execute a Business Associate Agreement (BAA) upon request.
You are solely responsible for ensuring your use of the platform complies with HIPAA, applicable state health privacy laws, and any institutional policies governing data handling.
PIN retains all rights to the platform, software, algorithms, and aggregated insights derived from the Services. You retain ownership of the data you upload, subject to our right to process it to provide the Services.
You grant PIN a limited license to use your data solely to operate and improve the Services, in accordance with our Privacy Policy and applicable agreements.
You agree to maintain the confidentiality of any non-public information about PIN or its platform that you access through the Services. This obligation survives termination of these Terms.
We aim to provide 99.9% uptime as described in our Service Level Agreement. We reserve the right to modify, suspend, or discontinue any aspect of the Services with reasonable notice. Planned maintenance will be communicated in advance via our system status page.
Fees for premium services are governed by your subscription agreement. All fees are non-refundable except as expressly stated in your agreement. We reserve the right to suspend access for non-payment after reasonable notice.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PIN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CLINICAL INSIGHTS GENERATED CONSTITUTE MEDICAL ADVICE. YOU ARE SOLELY RESPONSIBLE FOR CLINICAL DECISIONS MADE USING THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIN'S LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Either party may terminate these Terms with 30 days' written notice. PIN may suspend or terminate access immediately for material breach, including violation of HIPAA or unauthorized data handling. Upon termination, you will cease using the Services and we will provide a data export within 30 days.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may update these Terms periodically. Material changes will be communicated via email or in-platform notification. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
